Welcome to Happy Tails.
These Terms of Service ("Terms") govern your access to and use of the Happy Tails website, online store, products, services, features, and related communications (collectively, the "Services").
Throughout these Terms, "Happy Tails," "we," "us," and "our" refer to Happy Tails, an online business operated from Mexico City, Mexico. "You" and "your" refer to any visitor, customer, or other user of the Services.
By accessing our website, using our Services, or purchasing a product from us, you agree to these Terms and to any policies incorporated into them by reference, including our Return & Refund Policy, Shipping Policy, and Privacy Policy.
If you do not agree to these Terms, please do not use the Services.
1. Eligibility and Use of Our Services
By using our Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or otherwise have the legal capacity and authorization necessary to enter into a binding agreement.
You may not use our Services or products for any unlawful or unauthorized purpose or in any manner that violates applicable law.
You may not interfere with the security or proper operation of our website, introduce malicious code, attempt unauthorized access, scrape or exploit the Services in an abusive manner, or use the Services to violate the rights of Happy Tails or any third party.
2. Products and Product Information
We make reasonable efforts to display and describe our products accurately.
However, product colors and appearance may vary depending on your device, screen settings, lighting, manufacturing variations, or other factors.
Product dimensions, weights, specifications, materials, compatibility information, photographs, and descriptions may contain reasonable variations.
We reserve the right to modify or discontinue products, features, descriptions, or availability at any time, subject to applicable law.
We do not guarantee that every product displayed on our website will be available at all times.
3. Pet Product Use and Safety
Happy Tails offers products intended for use by or in connection with pets.
You are responsible for selecting products appropriate for your pet's size, age, breed, behavior, health, and individual needs and for using products according to their instructions and intended purpose.
Pets should be appropriately supervised when using toys, accessories, feeding products, walking equipment, or other products where supervision is reasonably appropriate.
Please inspect products regularly for wear, damage, loose components, or other conditions that could make continued use unsafe. Discontinue use if a product becomes damaged or presents a potential safety risk.
Product information provided through our Services is for general informational purposes only and does not constitute veterinary, medical, nutritional, or other professional advice.
If you have questions regarding your pet's health, medical condition, diet, or safety, please consult a qualified veterinarian or other appropriate professional.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited.
4. Orders and Acceptance
Placing an order through our website constitutes an offer to purchase the selected products. Submission of an order does not necessarily mean that Happy Tails has accepted the order.
We reserve the right, subject to applicable law, to accept, reject, limit, or cancel an order for legitimate reasons, including:
- Product unavailability;
- Pricing or product-information errors;
- Suspected fraud or unauthorized transactions;
- Shipping restrictions;
- Inability to verify payment or customer information;
- Quantity limitations; or
- Other circumstances that reasonably prevent fulfillment.
If we cancel an order after payment has been collected, we will issue the applicable refund to the original payment method.
We may reasonably limit quantities purchased per person, household, account, order, payment method, or shipping address.
5. Customer Information
You agree to provide current, complete, and accurate purchase, billing, contact, and shipping information.
You are responsible for reviewing your information before submitting an order.

We will make reasonable efforts to assist you but cannot guarantee that order or shipping information can be modified after processing or fulfillment has begun.
6. Prices, Taxes, and Payment
Unless otherwise stated, prices displayed on our website are in U.S. dollars (USD).
Applicable taxes, shipping charges, discounts, and other charges will be displayed or calculated as appropriate during checkout.
We reserve the right to change product prices before an order is placed.
You agree to provide valid and authorized payment information and authorize us and our payment service providers to charge the amounts shown at checkout.
If a material pricing or product-information error affects an order, we may contact you to provide an opportunity to proceed on corrected terms or cancel the affected order and issue a refund, as appropriate and permitted by applicable law.
7. Promotions and Discount Codes
Happy Tails may offer discounts, promotional codes, bundles, giveaways, or other promotional offers.
Promotions may be subject to additional terms, eligibility requirements, expiration dates, quantity limitations, and exclusions.
Unless otherwise stated, promotional offers cannot be combined.
We reserve the right to modify, suspend, or terminate a promotion where permitted by law, including in cases of error, fraud, abuse, or circumstances materially affecting the promotion.
8. Shipping and Delivery
Happy Tails currently sells and ships products within the United States, subject to the destinations and restrictions available at checkout.
Processing, shipping, and delivery estimates are provided based on information reasonably available to us.
Actual delivery may be affected by carrier operations, weather, holidays, address issues, product availability, or other circumstances.
Our Shipping Policy, as displayed on our website, provides additional information regarding processing, shipping, tracking, delivery, and related matters and is incorporated into these Terms by reference.
If we determine that merchandise cannot be shipped within an applicable represented timeframe, we will address the delay in accordance with applicable law, including providing notices, cancellation options, or refunds where required.
Nothing in these Terms is intended to eliminate or restrict rights relating to merchandise that cannot be shipped within a promised or otherwise legally applicable timeframe.
9. Returns, Refunds, and Cancellations
Returns, refunds, and order cancellations are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
Eligible return requests generally must be initiated within 15 days after delivery, subject to the conditions and exceptions contained in our Return & Refund Policy.
Eligible orders may be canceled within the cancellation window provided by our store, currently 15 minutes after the order is placed, provided processing or fulfillment has not prevented cancellation.
We do not currently process direct exchanges. Please refer to our Return & Refund Policy for information regarding returns and purchasing a different product or variation.
Nothing in these Terms or our Return & Refund Policy limits rights or remedies that cannot legally be waived under applicable law.
10. Delivery Issues
Lost-package, damaged-product, defective-product, incorrect-item, and related claims will be handled in accordance with our applicable policies and applicable law.
If you experience a delivery or product issue, please contact us promptly at wagging.tail.ht@gmail.com so we can investigate and determine an appropriate resolution.
Nothing in this section transfers to the customer any responsibility that applicable law requires Happy Tails to bear.
11. Third-Party Services
Our Services may use or integrate with third-party providers that help us operate our store, including ecommerce platforms, payment processors, analytics providers, fulfillment providers, shipping and logistics services, marketing platforms, and other technology and service providers.
Certain third-party services may be governed by their own terms and privacy practices.
Happy Tails is not responsible for independent third-party websites or services outside our reasonable control.
The presence of a link to a third-party website does not necessarily constitute our endorsement of that website, its products, services, or content.
12. Intellectual Property
The Happy Tails name, branding, logos, graphics, website design, original photographs, videos, written content, product presentation, and other original materials made available through the Services are owned by or licensed to Happy Tails and are protected by applicable intellectual property laws.
You may access and use our website for personal, non-commercial shopping purposes.
Unless authorized by us or otherwise permitted by law, you may not reproduce, distribute, modify, publish, commercially exploit, or create derivative works from our protected content.
Third-party trademarks, product names, images, and other intellectual property remain the property of their respective owners.
13. Reviews, Feedback, and User Content
If you submit reviews, photographs, videos, comments, suggestions, feedback, or other content to Happy Tails, you represent that you have the right to provide that content and that doing so does not violate another person's rights.
You retain ownership of content that you own.
By voluntarily submitting content to us for publication or promotional use, you grant Happy Tails a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute that content in connection with operating, improving, and promoting Happy Tails, to the extent permitted by applicable law.
We may decline to publish or may remove content that is unlawful, fraudulent, abusive, infringing, deceptive, irrelevant, or otherwise inappropriate.
Nothing in this section permits Happy Tails to falsely represent, manipulate, or mischaracterize customer reviews or endorsements.
14. Prohibited Conduct
You may not use the Services to:
- Violate applicable law;
- Infringe intellectual property or other rights;
- Submit fraudulent, false, or materially misleading information;
- Engage in payment, refund, promotion, or return fraud;
- Introduce malware or malicious code;
- Attempt unauthorized access to our systems;
- Interfere with the operation or security of the Services;
- Unlawfully collect personal information; or
- Use automated systems in a manner that materially disrupts or abuses the Services.
We may restrict or terminate access to the Services when reasonably necessary to address prohibited conduct, subject to applicable law.
15. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, EXCEPT FOR WARRANTIES AND RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.
WE DO NOT GUARANTEE THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM EVERY HARMFUL COMPONENT.
Product-specific warranties, if any, will be as expressly provided with the applicable product.
Some jurisdictions do not allow certain warranty disclaimers. Where such restrictions apply, these disclaimers apply only to the maximum extent permitted by law.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAPPY TAILS AND ITS OPERATOR, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAPPY TAILS' AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PRODUCT PURCHASE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO HAPPY TAILS FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
Because certain jurisdictions do not permit some exclusions or limitations of liability, some of the limitations above may not apply to you.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Happy Tails, its operator, employees, contractors, and agents from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, material violation of these Terms, or infringement of another person's rights.
This provision does not require you to indemnify Happy Tails for conduct for which indemnification cannot lawfully be required.
18. Privacy
Your use of our Services is subject to our Privacy Policy, which describes how we collect, use, disclose, and otherwise process personal information.
By using the Services, you acknowledge that you have had an opportunity to review our Privacy Policy.

When you place an order, create an account, or otherwise communicate with us electronically, you agree that we may send transactional communications reasonably necessary to administer your order, account, returns, refunds, shipping, security, or customer-service requests.
Marketing communications are subject to applicable consent requirements and available unsubscribe or opt-out mechanisms.

The current version will be posted on our website together with its "Last updated" date.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where appropriate.
The remaining provisions will continue in effect.

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.
23. Entire Agreement
These Terms, together with our Return & Refund Policy, Shipping Policy, Privacy Policy, and other terms or policies expressly incorporated by reference, constitute the agreement between you and Happy Tails concerning your use of the Services and purchases through our store, subject to applicable law.
24. Governing Law
These Terms are governed by the applicable laws of Mexico and, where applicable, Mexico City, without regard to conflict-of-law principles, except to the extent otherwise required by applicable law.
Because Happy Tails sells products to consumers in the United States, nothing in these Terms is intended to deprive a customer of any mandatory consumer protection, statutory right, remedy, or other protection that applies to the customer or transaction under applicable United States federal or state law and that cannot lawfully be waived by contract.
25. Dispute Resolution
If you have a concern or dispute regarding Happy Tails, your purchase, or these Terms, we encourage you to contact us first at wagging.tail.ht@gmail.com so that we can attempt to resolve the matter directly.
Nothing in this section requires you to waive a right or remedy available under applicable law.
These Terms do not currently require mandatory arbitration and do not contain a class-action waiver.
Any dispute that cannot be resolved directly will be handled by the courts or other competent authorities having jurisdiction under applicable law.
26. Consumer Rights
Nothing contained in these Terms, our Return & Refund Policy, Shipping Policy, Privacy Policy, or other store policies is intended to exclude, restrict, or waive consumer rights that cannot legally be excluded, restricted, or waived.
Where applicable federal, state, or other consumer protection law provides greater or additional rights, those rights will apply.
